    Real Estate Transactions utilizing the 1031 Exchange

    Whenever you sell a business or an investment property and have a gain, you generally have to pay tax on the gain at the time of sale. IRC Section 1031 provides an exception and allows you to postpone paying tax on the gain if you reinvest the proceeds in similar property as part of a qualifying like-kind exchange. Gain deferred in a like-kind exchange under IRC Section 1031 is tax-deferred, but it not tax free. The challenges of completing a 1031 Exchange transaction are varied. It is often difficult to locate a suitable like kind property in the required time and/or find a replacement property that is the proper equity amount, has the right debt structure, provides for diversification, and is of sufficient size to allow for cost effective, professional property management.
